Welcome to FocusGuard! These Terms of Service ("Terms") govern your use of the FocusGuard Chrome extension ("Extension" or "Service"). By installing and using FocusGuard, you agree to these Terms. If you don't agree, please do not use the Extension.
1. Acceptance of Terms
By downloading, installing, or using FocusGuard, you agree to be bound by these Terms of Service and our Privacy Policy. These Terms constitute a legally binding agreement between you and FocusGuard.
2. Description of Service
FocusGuard is a free Chrome browser extension that helps you stay focused and productive by:
- Blocking access to distracting websites during configured work hours
- Providing customizable work schedules and website blocking lists
- Offering productivity statistics and tracking features
- Allowing temporary snooze functionality for quick access
3. License and Permitted Use
3.1 Grant of License
We grant you a personal, non-exclusive, non-transferable, revocable license to use the FocusGuard Extension for your personal productivity purposes, subject to these Terms.
3.2 Permitted Uses
You may:
- Install and use the Extension on devices where you have Chrome installed
- Configure work hours, blocking lists, and settings as needed
- Use the Extension for personal or professional productivity
3.3 Prohibited Uses
You may NOT:
- Reverse engineer, decompile, or disassemble the Extension (except as permitted by law)
- Remove or modify any proprietary notices or labels
- Use the Extension for any illegal purpose or in violation of any laws
- Attempt to gain unauthorized access to our systems or other users' data
- Sell, rent, lease, or redistribute the Extension
- Use the Extension to harm, harass, or violate the rights of others
4. User Responsibilities
4.1 Your Configuration
You are responsible for:
- Properly configuring your work hours and blocked websites list
- Understanding that blocking is automatic during configured times
- Managing your own productivity and work schedule
- Backing up your settings if needed (settings sync via Chrome)
4.2 Compliance
You agree to:
- Use the Extension in compliance with all applicable laws and regulations
- Not use the Extension to bypass security measures on other systems
- Not use the Extension in any way that could damage or impair the Service
5. Free Service
FocusGuard is provided free of charge. We reserve the right to:
- Introduce paid features or premium versions in the future
- Modify, suspend, or discontinue the Service at any time
- Change these Terms with notice to users
Current users will always have access to the free version with its current features.
6. Intellectual Property
FocusGuard and all related trademarks, logos, and content are the property of FocusGuard or its licensors. These Terms do not grant you any rights to use our trademarks or branding.
7. Disclaimer of Warranties
Important: Please read this section carefully.
THE EXTENSION IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
- No Guarantee of Availability: We do not guarantee the Extension will always be available or error-free
- No Guarantee of Blocking: While we strive for reliable blocking, we cannot guarantee all distractions will be blocked
- No Guarantee of Productivity: Results vary by individual; we make no promises about productivity improvements
- No Warranty of Fitness: The Extension may not meet your specific requirements
- No Warranty of Accuracy: Statistics and tracking features may not be 100% accurate
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW:
FocusGuard and its developers shall not be liable for any:
- Indirect, incidental, special, or consequential damages
- Loss of profits, data, or productivity
- Missed deadlines or work due to Extension malfunction
- Damage to your device or data loss
- Any other damages arising from use or inability to use the Extension
Your sole remedy: If you're dissatisfied with the Extension, stop using it and uninstall it.
Maximum Liability: In any case, our total liability to you shall not exceed $10 USD or the amount you paid to use the Extension (currently $0), whichever is greater.
9. Important Limitations
9.1 Not a Parental Control Tool
FocusGuard is designed for adult self-regulation, not as parental control software. It is not foolproof and can be disabled by the user.
9.2 Not Medical or Professional Advice
FocusGuard is a productivity tool. It does not provide medical, therapeutic, or professional advice. If you have ADHD, addiction issues, or other conditions, please consult appropriate professionals.
9.3 Emergency Access
The Extension can be disabled or uninstalled at any time. It should not be used to block access to emergency services or critical systems.
10. Modifications to Service
We reserve the right to:
- Modify or discontinue the Extension at any time, with or without notice
- Update features, change functionality, or remove features
- Perform maintenance that may temporarily interrupt service
We'll try to provide notice of significant changes, but are not obligated to do so.
11. Modifications to Terms
We may update these Terms from time to time. When we do:
- We'll update the "Last Updated" date at the top
- Material changes will be notified through the Extension or our website
- Your continued use after changes constitutes acceptance of the new Terms
- If you don't agree with changes, please stop using the Extension
12. Termination
12.1 By You
You may stop using the Extension at any time by uninstalling it from Chrome. Your data will be removed from your device according to Chrome's policies.
12.2 By Us
We may suspend or terminate your access if:
- You violate these Terms
- You use the Extension illegally or harmfully
- We discontinue the Service
- Required by law
13. Third-Party Services
FocusGuard uses third-party services:
- Chrome Web Store: Distribution and updates (governed by Google's terms)
- Mixpanel: Anonymous analytics (see our Privacy Policy)
We are not responsible for third-party services or their terms and policies.
14. Governing Law
These Terms shall be governed by and construed in accordance with the laws of your jurisdiction, without regard to conflict of law provisions.
15. Dispute Resolution
If you have a dispute:
- Review the Extension: Leave feedback on the Chrome Web Store
- Uninstall Option: You may uninstall the Extension at any time
- Formal Action: If needed, disputes will be resolved in accordance with applicable laws
16. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
17. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and FocusGuard regarding the Extension.
18. No Waiver
Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.
19. Assignment
You may not assign or transfer these Terms. We may assign our rights and obligations without restriction.
20. Feedback
We welcome your feedback about these Terms and the Extension.
